Terms & Conditions

These Terms & Conditions (hereinafter referred to as the "T&C") are applicable to all the participants/contestants of the ‘Subscribe & Win Offer’ (hereinafter referred to as the "Offer") promoted /organized on SPICE DIGITAL LTD (hereinafter referred to as "SDL") in association with TATA TELESERVICES LIMITED (TTSL) & TATA TELESERVICES (MAHARASHTRA) LIMITED (TTML) (hereinafter TTSL and TTML collectively referred to as "TTL"). The T&C can be amended or varied from time to time by SDL/TTL. Participation in the Offer amounts to acceptance of these terms & conditions.

1. Offer ongoing since 22^nd sept'10 only between 00.00 hours to 23.59 hours.
2. Mechanics of the Offer:
1. Participant can participate through IVR, SMS, USSD & OBD based platform to subscribe "Live Aarti" services.
2. Total 60 Participants generating the maximum numbers of minutes of usages for the above services shall become eligible to win the prizes, which shall be declared at the end of the Offer period.
3. Details of Prize:
• Each Winners of the Offer will win one silver (20gm) statutes of deities.
3. Participation in the Offer is purely voluntary. No entry fee is payable for participation in the Offer except Premium call charges and/or Subscription charges for the above subscribing to "Live Aarti" service, as applicable, The charges paid by the Participant/s are towards the Live Aarti service and no additional charge will be collected from the Participant/s for participation in the Offer. .
4. The Offer is open for subscribers of TTL only, citizen of India and resident in India aging 18 years or more as on the date of entering/participating in the Offer (production of Government accredited date of birth certificate by the winner of the Offer is mandatory).
5. Employees of SDL, TTL, sponsors of the prizes, associated agencies and their immediate family members and relatives are not eligible to participate in this Offer. 
6. SDL & TTL shall not be responsible for any loss or damage suffered by the participant while participating in the Offer. And any failure by SDL to enforce any of these terms of this T&C in any instance(s) shall not give rise to any claim by any person against SDL. Further SDL & TTL shall not be responsible in any way for failure/delays of any backend technology and the resultant inability of a Participant to send in his/her entry/SMS or register/participate in the Offer.
7. Participants subscribing to "Live Aarti" service during the Offer Period shall become eligible to participate in the Offer.
8. Sixty (60) Entries generating maximum number of usage of minutes for Live Aarti Service during the Offer Period shall be considered as winner of the Offer. TTL and SDL shall not be responsible for non-receipt of any entry.
9. The Participant/s winning the Offer should also produce a valid ownership proof of the mobile number used for participation in the Offer to the satisfaction of SDL and TTL. At the time of collecting prize, successful Participant shall be required to satisfy SDL that winning entry was sent by him/her by producing appropriate verification of their mobile number to SDL’s satisfaction & photo ID.
10. The winning Participant/s of the Offer shall be required to produce photo identity proof, proof of ownership of mobile phone number (from which he/she have participated) at the time of receiving the Prize. In case false/fake identification details are submitted, the concerned winning participant/s shall be disqualified and will be liable for prosecution action. 
11. Decision of SDL & Tata Docomo with respect to selection of winning Participant/s shall be final and binding upon the Participants.
12. Participant/s winning the Offer gift shall be informed by SDL/Tata Docomo in such manner as may be decided by SDL/Tata Docomo from time to time. And the winning Participant must claim the Gift within 30 days from the date when the Offer is over and/or from the date of declaration of the winner, which ever is earlier, at such place as may be decided by SDL/Tata Docomo. All costs and expenses for collection of Gift shall be borne by the winner. The winner of the Offer shall be announced through TTL’s website within 14 days after the closure of Offer.
13. All entries will be treated as the property of SDL and can be used by SDL for any promotional and/or commercial activity & the participants waive all rights of whatsoever nature in the said entries in favor of SDL by participating in the Offer.
14. SDL & TTL in its absolute discretion may publicize, broadcast or otherwise disclose a winner’s name, particulars, likeness, statements or any recording of their voice in advertising or promotional activities concerning this Offer, or generally. SDL may promote or advertise that a winner has won the Offer. SDL may also require winner to participate in a photo, video and/or film session and acknowledge that SDL has the absolute and exclusive right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it may deem fit without any consideration or payment of similar nature to such winner of the Offer.
15. SDL & TTL reserves the right to extend the date of the Offer, cancel, modify or change the terms and conditions of the Offer, change the manner in which the Offer is organized, discontinue or terminate the Offer at any time or to accept or reject any entries/subscription at their absolute discretion without giving any prior notice and without assigning any reason whatsoever.
16. The Prize shall not be transferable or substituted for cash and no such request shall be entertained by SDL/TTL. 
17. Any levies, duties, incidental charges and taxes wherever applicable on the prize(s), shall be borne by the winner of the Gift. The winner of Offer may submit the proof of depositing the tax due on the Gift (i.e. challan of depositing the tax) at the time of claiming the Gift. Alternatively, SDL will be deducting taxes at source on the Gift, therefore, the person/ successful participant claiming the Gift must furnish his/her PAN number while claiming the Gift and in absence of PAN number, SDL will not issue any TDS certificate to the winner of the Offer. The Gift/s shall be subject to all the applicable laws of India, including all the tax laws. All applicable regulatory and statutory duties, cess, surcharges, taxes (including TDS), insurances, transfer fees, registration fees etc. that may be applicable to avail/use the Gift/s will be borne exclusively by the winner.
18. In the event of any winner choosing not to accept a prize or forfeit any and/or all claims qua the Gift or if SDL is unable to reach/contact the winner at his/her mobile number from which he/she had participated in the Offer, then SDL shall have the absolute discretion to either forfeit the Gift or deal with such Gift as it may deems fit.
19. Any attempt by a Participant to deliberately damage or undermine the legitimate operation of the activity is a violation of Criminal and Civil Laws and should such an attempt be made, SDL & TTL reserves the right to seek damages from any such Participant to the fullest extent permitted by law.     
20. The Participant hereby understands and gives his/ her irrevocable consent for personal information relating to the Participant to be exchanged with TTL, SDL and its vendors or published and/or communicated to/in any media that it may deem fit, and TTL, SDL or its vendors may, at their sole discretion choose to publish or disclose the name, phone number, and/or photographs of the Offer, if required.
21. The Gift under the Offer is neither assignable nor transferable nor exchangeable under any circumstances. All the Gift/s shall be subject to such other terms and conditions as may be applicable to specific Gifts and shall have to be duly complied with by the winner of the Offer.
22. This Offer is subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of SDL & TTL. TTL and SDL shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, terrorist attack, inevitable accidents, acts of god or any other circumstances amounting to Force Majeure.
23. This Offer is subject to guidelines/ directions issued by the Telecom Regulatory Authority of India or any other statutory authority from time to time.
24. SDL/TTL is neither responsible nor guarantees the quality of the goods/services being offered as Gift/s nor is it liable for any defect or deficiency of goods or services so obtained/availed, by the winner under this Offer. Participant should contact the Merchant Establishments / company manufacturing / producing the Gift directly in case of any complaints relating to the defect in the Gift. Neither TTL nor SDL will be liable for any claim, damage, refund, exchange, repair, replacement of the Gift
25. The Participant acknowledges and agrees that all copyright and trade marks and all other intellectual property rights in the content/website and all material or content related to the Offer shall remain, at all times, owned by SDL/TTL/their respective owners. All material and content contained in this website is made available for their personal and non-commercial use only. Any other use of the material/ content on this website and/ or any information disseminated by SMS or any other means of communication are strictly prohibited.
26. All disputes shall be subject to the exclusive jurisdiction of Delhi Courts only.
27. The aggregate liability of SDL, in case of any damage, loss, cost, claim, liability or expense (including legal costs and expenses) caused to or incurred by any act, omission or representation in respect of the Gift of this Contest to any individual winner, shall not exceed the value of the Gift.
